Personal Data Protection in Labour Law PDF Print E-mail

Few days ago I participated in a conference about personal data protection which was organized by Akademia Leona Kozminskiego and GIODO in Warsaw. The conference titled “Personal Data Protection in Labour Law” was focused on the issue of privacy in relation to labour law and new technologies used to control employees during their working hours. There were several interesting lectures, some of which will be available shortly on GIODO’s website (in Polish only, I believe). Here are some conclusions which are worth pointing out:

-         collecting personal data during an employment process is problematic for employers, in particular it is unclear in what scope it can be processed (gathered),

-         there are known issues related to privacy and personal data protection in the process of cooperation between employers and trade/labour unions,

-         new technologies give new opportunities but nobody knows where the acceptable limit of supervising employees is.

As we can read on the Inspector's General for the Protection of Personal Data website, 43% of the Polish society is aware of their right to privacy and personal data protection. That's the best score in the European Union. As Michal Serzycki (Inspector General) said, the aforementioned score is an effect of the cooperation with private entities but also universities and local authorities.

 

Some conclusions:

  • It is important to take care of personal data protection. Especially, when 43% of your clients are aware of their rights and your duties.
  • Any personal data disclosure can ruin your public relations and in the end - your business. That's clearly visible in banking and capital sectors, but also many others (medical, insurance etc.).
  • Michal Serzycki and his team do their job well. We can read and hear about personal data protection and Inspector's General several times a week.
